On Thursday, the federal court of appeals allowed President Donald Trump to continue collecting tariffs under emergency law for now.
The Federal Circuit Court of Appeals granted an emergency motion from the Trump administration, claiming that the suspension is “important to the country’s national security.”
The Court of Appeals temporarily suspended an order issued the previous day from the Federal Trade Court.
Trump is facing several lawsuits claiming that his “liberation day” tariffs exceeded his authority and relied on his whim to leave the country’s trade policy.
A panel of three judges at the U.S. International Trade Court determined that Trump had summoned the International Emergency Economic Force Act of 1977 to overstep his authority to declare a national emergency and plaster tax on imports from almost every country in the world.
The ruling was a major setback for Trump, whose volatile trade policies shook financial markets, paralyzed businesses with uncertainty, and for fear of rising prices and slowing economic growth.
